Abstract
The subject of this research in the field of Roman Law is located around the problem of finding the most appropriate solutions in the domain of a very sensitive and subtle matter that seems always current - criminal procedure (lat. Iudicia publica). Given the fact that the dissertation it’s about legal and historical sciences, the bigger part of it is devoted - first, to the thorough examination of the general institutions of the Roman criminal procedure; and then the other major institutes met at criminal trials in Rome and in the provinces, in various historical periods.
Methodological framework of this dissertation consists of more scientific methods, combined with the application of several complementary methodological procedures. During the research and writing of the thesis are used specific methodological techniques here primarily including: historical method (needed because of the specific area); further legal and normative-teleological method; comparative method; methods of analysis and synthesis; induction and methods of deduction; methods of generalization and specialization; methods of classification and description, and others. The use of all listed methods resulted in the description, analysis and explanation of the institutes which are the subject of close study, and sublimation of emerging knowledge, allowing us to conduct a proper scientific prediction
