Abstract
Public procurement is the process of using public funds by the contracting
authorities (state bodies, units of local self-government, public enterprises, legal
persons established for the specific purpose for meeting needs of public interest and
other legal entities that are funded or established by other contract authorities) in
order to obtain certain goods, services and works, mostly from commercial bidders.
The public procurement system in Republic of Macedonia is regulated by the
Public Procurement Law (Official Gazette of RM No. 136/07, 130/08, 97/10, 53/11 и
185/11). The Public Procurement Law along with the acts in this area is a
comrehensive legal framework which is largely harmonized with the EU аcquis
communautaire. The current normative framework for public procurement in the
Republic of Macedonia, ensures compliance of the fundamental principles of
transparency, equal treatment, efficiency and economy in the awarding of public
contracts. The necessity of a normative framework that is a hight lavel harmonized
with the European legislation is one of the basic requirements of the European
Union, and in order for faster access of the Republic of Macedonia in the European
integration processes.
