Abstract
This contribution will explore the evolving landscape of strict liability in the context of autonomous vehicles (AVs) across Europe. As technological advances continue to transform the legal framework, this study investigates how different European jurisdictions address liability for AV-related road traffic accidents.
Analyzing the interplay between AV technology and legal regulation, the paper examines strict liability regimes in Germany, Austria, France, the Netherlands, Italy, Poland, Greece, Spain, and the UK. It scrutinizes criteria for determining liable parties—whether vehicle owners, keepers, or operators—and the scope of covered risks, encompassing personal injury, property damage, and technical failures.
Key aspects explored include variations in contributory negligence standards, exceptions for technical defects, and protections afforded to drivers versus other road users under strict liability laws. The study underscores disparities in liability caps, mandatory insurance requirements, and their implications for victims of AV accidents.
Ultimately, the research advocates for harmonizing strict liability frameworks across Europe to ensure equitable compensation and legal clarity amid the rise of autonomous driving technologies.
