Abstract

Summary
Regulation of the child support in Republic of Macedonia haven't been changed for more than 25 years, since the adoption of the Family law in 1992. Legal solutions regulating child support are outdated and causing serious consequences in their application, which is best illustrated by the huge number of court procedures related to child support. In this paper, authors analyze the model of child support regulation, foreseen in the Family Law and highlight the weaknesses of the existing legal solutions. In this paper, the authors make a comparative legal analysis of the regulation of child support in several European legislations as well as the jurisprudence of the European Court of Human Rights in this area. Based on the analysis of the shortcomings in the regulation of the child support in Macedonian legislation, considering the best models of child support from the European countries, the authors propose several changes in the existing legislation that will overcome the weaknesses in the existing legal solutions and will provide greater protection of the rights and interests of the children with regard to their support.
