Abstract

The risk of poverty and social exclusion in older people increases with age. The pension system is one of the most important segments of the overall social security system of any country. This system is comprised of a set of legal norms and administrative and financial institutions that regulate the insurance of the risk of old age and disability and loss of nourisher. European Union countries are in very different situations, although they face similar demographic challenges. As a result of low birthrates, aging populations, and other non-demographic factors in the MembersStates, a significant pension reform has been made in the last ten years. Pensionsystems differ throughout the EU-27 as each system reflects in a certain way a specific institutional arrangement. Still there are some features which most of these systems contain, and similar developments can be observed as many Member States are faced with the same general challenges regarding pension sustainability and adequacy. In general, it is useful to distinguish different pension pillars: a public mandatory old-age pension, occupational pensions and private savings plans. The main structure is common across all pension systems. However, the size of each pillar depends on the institutional context of each Member State and therefore differs across the EU.The purpose of this paper is to present, explain and analyze the specifics of the various pension systems in the Member States of the EU and to find out which of them gives the best effect. This will result in policy recommendations and warnings that would be needed the most in reforming the national pension system in terms of adequate, safe and sustainable pensions.Applying the comparative-legal method will enable us to see the positive-legal solutions that exist in the pension systems of the EU Member States, as well as whose solutions and experiences our country should follow. In order to discover the content of the norms dedicated to the conditions for acquiring a pension, the paper will use the dogmatic method. The sociological method will investigate the social causes that have made the existence of a particular pension system with particular characteristics. For the purposes of the analysis, the decryption method will also be used.
