Abstract
Starting from the postulates of traditional contract law, the written form of the contract is imposed as a legal standard. However, this legal standard is not usually defined in legal texts, and therefore, in different epochs and phases of the development of contract law, it may have different interpretations, depending on the technological development of a particular society. The electronic form of the contract, which emerged and imposed as a new, inevitable and omnipresent modus of agreement, can be seen as a new, revolutionary manifestation and form of a written document. The trend in the overall global legislation is the dematerialization of electronic forms of contracts and the equalization of the legal effect and the effects of an electronic contract with a traditional contract, written on paper. The dilemma whether the electronic form of a contract represents a special form of contract no longer exists, especially in terms of its legal strength and validity. After all, the dynamic development of information and communication technologies requires a quicker adjustment of the law and the legal systems to new conditions and needs.
