Abstract
Авторот на трудот прави обид да ги оживее подзаборавените правни идеи својствени на приврзаниците на Природното право – како посебен правец во философијата на правото. Преку историско-компаративен пристап, тој се обидува да ги пренесе оригиналните инспиративни идеи на видни авторитети, философи и правници кои твореле од Антиката па сè до денес. Во трудот особено е обработено и влијанието на стоицизмот врз продуховениот развој на Римското право. Истовремено е дадена и остра критика на правниците позитивисти и на нивниот „нормативистички“ и некреативен правен пристап во изучувањето и во толкувањето на правото, кој е штетен како за студентите, така и за правното образование воопшто.
* The author of this paper attempts to revive somewhat forgotten legal ideas typical of the supporters of the Natural Law – as a separate course in the Philosophy of Law. Trough historical and comparative approach he tries to
convey the original inspirational ideas of prominent authorities, philosophers and lawyers who worked from Antiquity until today. Also in this paper the author processed the impact of the Stoicism on the ‘spiritual’ development of the Roman Law. At the same time it has been given a sternly critique of the positivist lawyers and their ‘normative’ and uncreative legal approach to legal study and interpretation of the law – which is harmful
as for the students themselves and for the higher legal education, in general.
