Abstract
The existence of an efficient system of protection of the property rights and
interests of the country and its authorities is impossible without the existence of a state
authority which will protect those rights and interests in front of the court and the other
state authorities and in front of the foreign and international courts. Such a state
authority exists today as an independent authority or as an organ component of a
certain ministry in a larger number of countries and it is known under the name of
national or public attorney’s office.
The public attorney’s office ccurred as a result of the development of the civiclegal
function of the country. The civic-legal function of the country occurred with the
formation of the national treasury, which has easily but surely separated from the
treasury of the kings through the historical development. Today in the contemporary
world this treasury is known under the name of Budget.An efficient legal authority with a basic competence to protect the property rights
and interests of the country and its authorities is necessary for each country because
the same provides stability of the country budget, and with that a normal realization of
the state functions. The Republic of Macedonia as an independent country, has
foreseen the the need of an existence of this legal authority, so in the year of 1997 it
has brought the Law of public attorney’s office. With this law the organizational
installation and the competency of the Public attorney’s office.
In this work the efficacy of the Public attorney’s office of the Republic of
Macedonia is being researched for the area of Kocani versus the efficacy of the
National attorney system of the Republic of Macedonia from the aspect of the number of
the the accepted and solved subject. The work contains a theme part in which among
the other a short historical development of the authority is given, its organizational
installation, competency, its collaboration with the legal authorities and the comparison of the installation and competencies of the Public attorney’s office of the Republic of
Macedonia and the installation and the competencies of the attorney’s offices of the
Balkan countries: Croatia, Serbia and Slovenia. In the conclusion of the work
suggestions are given for what is to be done in future in the Republic of Macedonia for
the efficacy of the Public attorney’s office to be improved.
