Abstract
The paper focuses on the multicultural features of the Macedonian society and the right to education in order to establish whether the legislative framework in
Macedonia offers equal opportunities for the realization of the right to education of all citizens, including non-majority communities, and aims to determine in which manner multiculturalism affect the educational policy and creation of human capital.
The first part of the paper presents the data related to the legal regulation of the access to education in the Republic of Macedonia in the first decade of its independence and the degree of representation of students by ethnicity in the educational sector.
The second part of this paper, however, places an emphasis on the new legislative amendments adopted and implemented on basis of the Ohrid Framework Agreement (OFA), understood as an essential instrument for promoting and maintaining the multicultural character of the Macedonian society. The analysis of the data registered during the implementation of the OFA directly related to the degree of representation of students from non-majority communities in education, and resulted with the conclusion that the education policy after the OFA regulatory amendments had a direct impact on the educational sector, and hence on the creation of human capital among minority communities.
