Abstract
Abstract: Republic of North Macedonia as a member of the European Convention of Human rights is obliged to respect human rights and freedoms foreseen by the Convention. However, in the period following the outbreak of the migrant’s crisis in 2015 until today, many violations or alleged violations toward migrants and asylum seekers have been registered either by non-governmental organizations or by local police. For example, NGO’s like Amnesty international together with local NGO Legis in 2015 have denounced violation of human rights and illegal detention of migrants that occurred in the Reception center for foreigners ‘Gazi Baba’ in North Macedonia. Other episodes of violation of basic human rights reported by the Belgrade Center for Human Right and the Macedonian Young Lawyers Association with the support from Oxfam, speak about illegal deportation and violent pushbacks of migrants occurred in countries along the Balkan route, among which also North Macedonia, where state officials denied access to asylum procedures for those seeking international protection, and unlawfully used force and violence against them. Taking this stand, the purpose of the contribution will be to analyze what violations of human rights and freedoms guaranteed by the European Convention on Human Rights, but also by other international instruments, have occurred in North Macedonia in the period from the beginning of the migrant crisis until today, and whether or not they have been denounced in front of the European Court of Human Rights. Furthermore, in case alleged violations haven’t been filed in front of the Court, the determine what reasons stand behind such actions.
