Abstract

The basic function of the court is the protection of human freedoms as the basic principle of a democratic state and a rule of law. Justice and righteousness are the primary leverage of the court in approaching the ideal of freedom. At the same time, the law appears to be a guarantor of freedom, but also as a rational and necessary restriction, only if it is provided with justifiable judicial protection in a society in which human relations are regulated by law, as well as on the principle of equality of rights and duties. The democratic state based on the principle of rule of law sets the court in an independent and independent pedestal in accordance with the consistent application of the principle of the division of power. Recognition of the right to an independent and impartial tribunal as a fundamental human right today constitutes the most important achievement of the concept of a democratic state and a rule of law.
