Abstract

The Law, in a subjective sense, understood as conscious and reasonable accomplishment of the rights and obligations of his subjects, must always keep an eye on subjects that do not have awareness of their legal powers and duties. Also, at stake is the question of consciousness and the will of the subjects when it comes to their collective expression, when there is an association among individuals within a legal person, whether affiliated individuals still retain their individual will and consciousness?!? Given this care for the basic, natural rights that belong to humans, it can be concluded that, a successful existence and functioning of legal relations and legal operations requires establishment of special legal institutions including a special law institute Agency, or legal agent as a person who can act, and take other legal matters in its own name and for its own benefit, but also on behalf of, and in somebody else's benefit. In legal theory there is a definition of agent as a legally competent person acting in the name and on behalf of incompetent and incapable individual, a person, and in the name and on behalf of legal entities when, with a statement of will, imparts some of their legal powers to the representative (agent), or execute some legal action. But there are also some institutes which are very similar to agency, but they have their own specific characteristics and they produce different legal powers, relationships and activities.
